ENKI-CLINICAL Terms of Use

Scope of Application
These Terms of Use apply to all ENKI-CLINICAL products and services, including but not limited to:
- ENKI-CLINICAL SUITE (integrated platform)
- Ultimate AVBG Calculator (arterial/venous blood gas analysis)
- ICU IV Infusion Calculator (critical care medication dosing)
- AIE™ — Antimicrobial Intelligence Engine
- INE™ — ICU Nutrition Engine
- CRRT Engine (renal replacement therapy)
- FTE™ — Fluid and Transfusion Engine
By requesting access to ANY ENKI-CLINICAL product, you agree to these Terms in their entirety.
1) Purpose and Clinical Disclaimer
ENKI-CLINICAL products are clinical decision-support tools intended to assist qualified healthcare professionals. They do not provide medical advice and do not replace bedside clinical judgment, local protocols, specialist consultation, or institutional policies.
The user remains fully responsible for all clinical decisions, prescriptions, calculations, and patient outcomes.
2) Intended Users Only
These products are intended only for licensed physicians, pharmacists, nurses, or trained healthcare staff operating under supervision, or trainees using them under a recognized clinical governance structure. They are not intended for laypersons, self-treatment, or non-clinical use.
3) Transparency When Using the Tool
The user agrees to be transparent and ethically compliant when ENKI-CLINICAL contributes to decisions, including when documenting notes, communicating with patients/families, presenting decisions to colleagues, or reporting incidents. If an institution requires disclosure of decision-support tools, the user must comply.
4) Trial Period Rules
During any trial period, the user agrees to test carefully before relying on the tool, to report suspected errors or unexpected behaviors to the developer, and to avoid unsafe reliance for high-risk decisions without independent verification. The trial exists specifically to evaluate suitability for the user's setting and devices.
5) Verification Duty
The user agrees to verify outputs against clinical reality and basic safety checks, including unit correctness, patient weight/age entry accuracy, renal/hepatic context, contraindications and interactions, and lab sampling timing and physiologic plausibility.
6) No Emergency Guarantee
All products are provided "as-is." They are not guaranteed to be available, accurate, complete, uninterrupted, or error-free in emergencies or unstable environments.
7) Prohibited Misuse
The user must not use any product to practice outside their scope, attempt to reverse-engineer, copy, clone, resell, distribute, or share activation access, remove branding, notices, disclaimers, or license controls, misrepresent any product as an official hospital system unless formally approved, or use any product for illegal, deceptive, or harmful purposes.
8) License, Access, and Compliance
Access may require an approval workflow and activation/confirmation code. The developer may refuse access, revoke access for misuse, or require re-verification for security or governance reasons.
9) Payments and Refunds
All purchases are final. No refunds after purchase, including claims of "not useful," "device incompatibility," "change of mind," or "unused."
10) Limitation of Liability
To the maximum extent permitted by law, the developer is not liable for clinical outcomes, direct or indirect damages, missed diagnoses, incorrect dosing decisions, lost profits, device or connectivity failures, or any harm arising from use or misuse. The user accepts full responsibility for clinical use and verification.
11) Indemnity
The user agrees to indemnify and hold harmless the developer from claims arising from misuse, practice outside scope, failure to verify, failure to follow local policy, or unauthorized distribution.
12) Updates, Changes, and Versioning
The developer may update features, terms, and access controls. Continued use after an update means the user accepts the updated Terms.
13) Governing Law and Disputes
Governing law: Republic of Iraq. Disputes should first attempt resolution by direct communication. If unresolved, disputes proceed under the chosen jurisdiction.

15) Acceptance
By using ENKI-CLINICAL products or accessing this site, the user confirms they have read these Terms of Use, understand them, and agree to be bound by them.
ENKI-CLINICAL Privacy Policy

1) Core Principle
ENKI-CLINICAL is built as an offline, clinician-controlled system.
We intentionally:
- ❌ do NOT track users
- ❌ do NOT collect patient data
- ❌ do NOT use analytics
- ❌ do NOT use ads
- ❌ do NOT sell or share personal information
Your data stays on your device. Period.
2) What Data We Collect
Only when you voluntarily submit an access request or license request, we may receive:
Account / Contact data: Name, Professional role, Email address, Phone number, Institution (optional).
Technical data (minimal): Device fingerprint or activation ID, App version, License status.
Purpose: Activation, support, and license validation only. Prevents unauthorized license key replication and ensures each license is tied to an authorized device.
3) What We Do NOT Collect

- ❌ Location tracking
- ❌ Browsing behavior
- ❌ Analytics / telemetry
- ❌ Cookies
- ❌ Background monitoring
The suite works offline. Clinical calculations remain locally stored only.
4) Local Device Storage
The application stores data locally using localStorage, IndexedDB, and Service Worker cache. This may include preferences, saved calculations, license state, and trial status. This data never leaves your device, is not accessible to the developer, is fully controlled by the user, and can be deleted by clearing browser/app data.
5) Email Communications
When you send an activation or support email, we receive only the information you type and metadata normally included in email headers. We use it only for responding, troubleshooting, and license issuance. We do not add you to mailing lists, send marketing emails, or share your email.
6) Data Sharing
We never sell, rent, trade, or disclose your information to third parties. Data may only be disclosed if required by law or court order, or if necessary to prevent fraud or abuse of the license.
7) Data Retention
We keep contact/license data only as long as needed for support, license management, and legal protection. You may request deletion at any time.
8) Security
We implement offline-first architecture, no external CDNs, no third-party scripts, minimal attack surface, local processing only, and device fingerprinting for license anti-piracy. However, no system is 100% secure. Users remain responsible for protecting their devices.
9) Children
ENKI-CLINICAL is intended only for healthcare professionals. It is not designed for minors.
10) Your Rights
You may request deletion of your contact data, correct inaccuracies, or stop using the software at any time. Simply email the developer.
11) Changes
We may update this policy. If updated, the new version and date will be clearly displayed inside the app. Continued use = acceptance.
